随着我国建筑业的不断发展及加入世界贸易组织,对我国建设项目质量、风险管理水平的要求不断提高,工程保险越来越显示其重要作用。本文通过对工程保险历史的回顾和对我国工程保险市场状况的分析,介绍了工程保险和保险合同的概念,对工程保险和它的主要险种以及保险合同作了详细的说明。本文对工程保险在投保过程中如何选择保险人、确定投保项目、估计费率、明确免赔额才能达到以最少保费获得最大安全保障的目的和如何确定工程保险的保险事故性质进行了分析。通过对我国工程保险合同新旧条款的比较,说明了我国在保险合同条件方面的发展以及需要更进一步完善的地方。本文将FIDIC土木工程保险合同条件与我国的相关情况进行了对比,说明了我国的工程保险在这方面存在的不足,提出了明确保险金额、确定保险责任、定明保险期限等丰富我国工程保险合同条件的改进建议。我国的工程保险,在借鉴FIDIC条件来完善我国相关合同条件的同时,还要结合我国的国情,着眼于未来,制定自己的发展目标和发展方向,逐渐由追赶方式过渡到并列方式,在工程保险领域融入国际市场。The thesis expounds the contents that are correlative with the conditions of contract for engineering insurance,such as the engineering insurance,the engineering insurance contract firstly.Secondly,it goes into the important contents. The dissertation shows us how to choose the insurer、fix insurance programme、estimate cost rate and regularizing franchise,we will gain the most safety by using the least premium during the cause of insurance, and expounds how to fix the kind of insurance accident for engineering insurance. And then,it indicates our improvement in the field of engineering insurance by the comparison of our old clauses of contract for engineering insurance with the new.Finally,the treatise finds out the shortcoming of our conditions of contract for engineering insurance and points out suggestions,such as regularizing insurance amount、fixing insurance responsibility and terms for the improvement, by the comparison of FIDIC conditions of contract for works of civil engineering construction with our’s. 保险,保险合同,工程保险,工程保险合同,工程保险合同条件
